Safety Evaluation Report

The NRC staff reviewed the Indian Point Nuclear Generating Unit Nos. 2 and 3 license renewal application for compliance with the requirements of Title 10 of the Code of Federal Regulations, Part 54, "Requirements for Renewal of Operating Licenses for Nuclear Power Plants," and prepared this report to document its findings. The document was issued on August 11, 2009, as "Safety Evaluation Report Related to the License Renewal of Indian Point Nuclear Generating Unit Nos. 2 and 3."

In November 2009, the report "Safety Evaluation Report Related to the License Renewal of Indian Point Nuclear Generating Unit Nos. 2 and 3" was issued as NUREG-1930.

On August 31, 2011, the staff issued Supplement 1 to NUREG-1930. This supplement documents the NRC staff’s review of supplemental information provided by the applicant since the issuance of NUREG-1930, including annual updates required by 10 CFR 54.21(b), and updated information and commitments in response to NRC staff requests for additional information.

On July 31, 2015, the NRC staff issued Supplement 2 to NUREG-1930. This supplement documents the NRC staff's review of supplemental information provided by the applicant since the issuance of Supplement 1, including information committed to by Entergy as documented in Commitment No. 30 (pertaining to reactor vessel internals), information required by 10 CFR 54.21(b), updated information and commitments, as well as information provided in response to NRC staff requests for additional information.

On August 1, 2018, the NRC staff issued Supplement 3 to NUREG-1930.  This supplement documents the NRC staff's review of supplemental information the applicant provided after the publication of Supplement 2, including annual updates required by 10 CFR 54.21(b), updated information to address new or updated interim staff guidance, and recent operating experience.

Environmental Impact Statement

NUREG-1437, "Generic Environmental Impact Statement for License Renewal of Nuclear Plants Regarding Indian Point Nuclear Generating Unit Nos. 2 and 3 (NUREG-1437, Supplement 38) Final Report," was issued in December 2010. This supplement documents the NRC staff's review of the environmental issues at the Indian Point Nuclear Generating, Unit Nos. 2 and 3 regarding the Entergy application for license renewal of that facility. The supplement was prepared in accordance with 10 CFR 51.71. This supplemental environmental impact statement includes the Staff's analysis that considers and weighs the environmental effects of the proposed action (license renewal), the environmental impacts of alternatives to the proposed action, and potential mitigative measures for reducing or avoiding adverse impacts. It also includes the Staff's preliminary recommendation regarding the proposed action.

On June 30, 2013, the staff issued NUREG 1437, Supplement 38, Volume 4 Final Report. This supplement includes corrections to impingement and entrainment data presented in the final SEIS, revised conclusions regarding thermal impacts based on newly available thermal plume studies, and an update of the status of the NRC's consultation under section 7 of the Endangered Species Act with the National Marine Fisheries Service regarding the shortnose sturgeon and Atlantic sturgeon.

On April 30, 2018, the NRC staff issued NUREG-1437, Supplement 38, Volume 5 for public comment. This supplement includes the NRC staff's evaluation of revised engineering project cost information for severe accident mitigation alternatives, newly available aquatic impact information, the additional environmental issues associated with license renewal resulting from the June 2013 revision to Table B–1 in Appendix B to Subpart A of Title 10 of the Code of Federal Regulations (10 CFR) Part 51 and NUREG–1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants, and incorporates the impact determinations of NUREG–2157, Generic Environmental Impact Statement for Continued Storage of Spent Nuclear Fuel, in accordance with the requirements in 10 CFR 51.23(b). Additionally, this supplement describes the reinitiation of consultation under Section 7 of the Endangered Species Act regarding the northern long-eared bat and provides an update on the status of the operating licenses for Indian Point Nuclear Generating Unit Nos. 2 and 3.

Timely Renewal for Indian Point Nuclear Generating Unit Nos. 2 and 3

"Timely renewal," is a term used to refer to the period beyond the original license expiration date during which a plant can continue to operate without a renewed license until the NRC makes a final determination on the license renewal application.  In order to enter "timely renewal," the licensee must have filed a sufficient application for renewal of its license at least five years before the expiration of its existing license.

The NRC received the Indian Point Nuclear Generating Unit Nos. 2 and 3 license renewal application on April 30, 2007, and determined it was sufficient for review on July 25, 2007.  

The current operating licenses for Indian Point Nuclear Generating Unit Nos. 2 and 3 were set to expire at midnight on September 28, 2013, and December 12, 2015, respectively. Because Entergy Nuclear Operations, Inc. filed a timely and sufficient application, it will be allowed to continue to operate Indian Point Nuclear Generating Unit Nos. 2 and 3 under its existing licenses until the NRC makes a final determination on the license renewal application.
