Edwin I. Hatch Nuclear Plant Unit 1 and 2 Application for Subsequent Renewal of Operating Licenses Documentation Pertaining to Section 106 of the National Historic Preservation Act
The U.S. Nuclear Regulatory Commission (NRC) has received an application from Southern Nuclear Operating Co., Inc. (SNC) for the Subsequent License Renewal for Edwin I. Hatch Nuclear Plant (HNP) Units 1 and 2, pursuant to NRC operating license (OCs) DRP-57 and NPF-5, respectively under Title 10 of the Code of Federal Regulations (10 CFR) Part 54 “Requirements for Renewal of Operating Licenses for Nuclear Power Plants” requesting the issuance of renewed operating license(s) for an additional 20 years. The NRC staff is conducting an environmental review of the application in accordance with 10 CFR Part 51, “Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions,” which implements the requirements of the National Environmental Policy Act of 1969, as amended (NEPA). The NRC staff is also conducting a Section 106 review of the application in accordance with the National Historic Preservation Act of 1966, as amended (NHPA).
For the purposes of NHPA Section 106, the undertaking before the NRC is whether to issue a SLR to SNC providing an option that allows for baseload power generation capability beyond the term of the current nuclear power plant operating license(s) to meet future system generating needs. The direct area of potential effect (APE) consists of lands within the approximately 2,244 ac (908 ha) HNP site, including the transmission lines up to the first substation, that may be directly or indirectly affected by land-disturbing or other operational activities associated with continued operations and maintenance and/or refurbishment activities. The indirect APE is a 6 mi (10 km) radius based off the HNP center point, located equidistant between Units 1 and 2. The NRC staff consulted with the Advisory Council on Historic Preservation, and the Georgia State Historic Preservation Officer (SHPO), 9 federally recognized Indian Tribes, and one State recognized Indian Tribe to identify historic properties of religious and cultural significance. The NRC staff also reviewed the information provided by SNC in its SLR application. Since no sites, buildings, or structures have been determined NRHP-eligible at HNP, activities associated with operations and maintenance would have no impact on historic and cultural resources. Therefore, the NRC staff has made a preliminary determination of no historic properties affected, pursuant to 36 CFR 800.4(d)(1). The NRC staff has documented this conclusion and additional information related to the SLR in the historic and cultural resources section of an environmental assessment of the SLR application (linked below).
The NRC staff is soliciting comments on the NRC’s Section 106 finding and the cultural resources information contained at the above link related to the SLR application.
