The Dow Chemical Company (EAF-RIII-2025-0071 (EA-24-122))
On June 9, 2025, the NRC issued a notice of violation to The Dow Chemical Company, for a severity level III problem associated with violations of Title 10 of the Code of Federal regulations (10 CFR) 20.2202(a)(2), “Notification of Incidents”; 10 CFR 30.50(b)(1), “Reporting requirements”; and 10 CFR 20.1204(a), “Determination of internal exposure.”
Snyder and Associates, Inc. (EAF-RIII‑2025‑0003)
On June 9, 2025, the NRC issued a notice of violation and proposed imposition of civil penalty in the amount of $9,000 to Snyder and Associates, Inc. for a severity level III violation of Title 10 of the Code of Federal regulations 20.1802, “Control of material not in storage”.
Geo Cim Inc. (EAF-RI-2025-0057)
On June 9, 2025, the NRC issued a notice of violation to Geo Cim Inc, for a severity level III violation of Title 10 of the Code of Federal regulations 30.34(c), “Terms and Conditions of Licenses," License Condition 14 of NRC License No. 52-17776-02.
Saint Joseph Regional Medical Center (EAF-RIII-2025-0014)
On May 27, 2025, the NRC issued a notice of violation (Notice) to Saint Joseph Regional Medical Center (licensee) for a Severity Level (SL) III violation. The SL III violation involved the licensee’s failure to monitor individuals’ occupational exposure from licensed and unlicensed radiation sources, as required by Title 10 of the Code of Federal Regulations (10 CFR) 20.1502(a)(1). Specifically, two interventional radiologists were not monitored for occupational extremity exposure to radiation from unlicensed sources under the control of the licensee.
Aaron Swan and Associates (EAF-RIV-2025-0049 / EA-24-133)
On April 28, 2025, the NRC issued a notice of violation (Notice) to Aaron Swan and Associates (licensee) for a severity level III violation. The violation involved the licensee’s failure to use a minimum of two independent physical controls that formed tangible barriers to secure portable gauges from unauthorized removal, when portable gauges were not under the control and constant surveillance of the licensee, as required by Title 10 of the Code of Federal regulations 30.34(i). The Notice also includes three SL IV violations associated with the licensee’s radiation safety program.
Fort Calhoun Station (EAF-RIV-25-002)
On April 16, 2025, the NRC issued a notice of violation (Notice) to Fort Calhoun Station (licensee) for a Severity Level (SL) III violation. The SL III violation involved the licensee’s failure to design and prepare radioactive materials for shipment so that, under conditions normally incident to transportation, the radiation level did not exceed 200 millirem per hour at any point on the external surface of the package, as required by Title 49 of the Code of Federal Regulations (49 CFR) 173.441(a) and 10 CFR 71.5.
Patriot Engineering and Environmental, Inc. (EA-24-115/ EAF-RIII-2025-0068)
On April 7, 2025, the NRC issued a confirmatory order (CO) to Patriot Engineering and Environmental, Inc. (licensee) confirming commitments reached as part of an alternative dispute resolution (ADR) mediation settlement agreement between the licensee and the NRC. The ADR mediation and subsequent CO were based on the results of an inspection conducted in response to the licensee’s failure to control a portable moisture density gauge at its Evansville, Indiana facility. The inspection staff identified three apparent violations: (1) failure to secure a portable gauge as required by Title 10 of the Code of Federal Regulations (CFR) 20.1802, and 10 CFR 30.34(i); (2) failure to secure a gauge from shifting during transport as required by 10 CFR 71.5(a) and 49 CFR 173.448(a); and (3) the failure to lock a gauge or an outer container when in transport, as required by a license condition. In consideration of the corrective actions and commitments outlined in the CO, the NRC agreed to refrain from issuing a notice of violation or proposing a civil penalty.
Saint Louis University (EA-23-121/EAF-RIII-23-015)
On April 3, 2025, the NRC issued a notice of violation and proposed imposition of Civil Penalty - $9000 (Notice) to St. Louis University (licensee) for a Severity Level (SL) III problem. The SL III problem involved the licensee’s failure to secure licensed materials from unauthorized removal or access as required by 10 CFR 20.1801; and the failure to perform radiation surveys before disposing licensed material by transfer to an authorized recipient, as required by 10 CFR 20.1501(a). These failures resulted in a unit dosage of radium-223 being disposed in the normal trash. In addition, the Notice included an SLIV violation of 10 CFR 35.40(a) that was dispositioned as a non-cited violation, consistent with Section 2.3.2.b of the Enforcement Policy.
Agilent Technologies, Inc., DE (EAF-Rl-2024-0013)
On March 27, 2025, the NRC issued a notice of violation and proposed imposition of civil penalty in the amount of $9,000 to Agilent Technologies, Inc. (licensee) for a severity level III violation. The violation involved the licensee’s failure to maintain control of licensed material that was in a controlled or unrestricted area and not in storage, as required by Title 10 of the Code of Federal Regulations (10 CFR) 20.1802. Specifically, a technician failed to account for a sealed source and is believed to have been disposed of in a dumpster that was subsequently transferred to a landfill.
Saint Francis Medical Center (EA-24-114/EAF-RIII-2024-0018)
On March 20, 2025, the NRC issued a notice of violation (Notice) and proposed imposition of civil penalty in the amount of $14,400 to Saint Francis Medical Center (licensee) for a Severity Level II problem associated with four related violations. The violations involved the licensee’s failure to: (1) have a written directive that was dated and signed by an authorized user before the administration of a therapeutic dosage of unsealed byproduct material, as required by Title 10 of the Code of Federal Regulations (10 CFR) 35.40(a); (2) provide high confidence that: (1) the patient’s identity was verified before each administration; and (2) each administration was in accordance with the written directive, as required by 10 CFR 35.41(a); (3) provide training to all individuals involved in yttrium-90 microsphere use, commensurate with the individual’s duties, as required by the licensee’s License Condition 14.C; and (4) ensure that radiation safety activities were being performed in accordance with licensee-approved procedures and regulatory requirements, as required by 10 CFR 35.24(b).
Hartford Hospital (EAF-RI-2024-0011)
On March 12, 2025, the NRC issued a notice of violation and proposed imposition of civil penalty in the amount of $9,000 to Hartford Hospital (licensee) for a severity level III violation. The violation involved the licensee’s failure to maintain information that was complete and accurate in all material respects, as required by Title 10 of the Code of Federal Regulations (10 CFR) 30.9(a). Specifically, a former employee completed sections of a Radioactive Spill Report with inaccurate concentrations and quantities.
Nelson Engineering (EA-2024-087/EAF-24-009)
On February 26, 2025, the NRC issued a notice of violation (Notice) to Nelson Engineering (licensee) for a Severity Level (SL) III violation. The SL III violation involved the licensee’s failure to have a qualified radiation safety officer, as required by License Condition 12 of NRC license 49-19036-01. In addition, the Notice included 5 SLIV violations involving the licensee’s failure to (1) perform leak tests on sealed sources, (2) perform physical inventories of sealed sources and/or devices, (3) have safety locks on portable nuclear gauges in storage, (4) maintain utilization logs for the use of portable nuclear gauges, and (5) perform annual audits of the radiation protection program.
Karmanos Cancer Center (EAF-RIII-2024-0013)
On January 14, 2025, the NRC issued a notice of violation (Notice) to Karmanos Cancer Center (licensee) for a Severity Level (SL) III problem and a SL IV violation. The SL III problem encompassed two violations involving the licensee’s failure to: (1) secure from unauthorized removal or access licensed materials that are stored in controlled or unrestricted areas, as required by Title 10 of the Code of Federal Regulations (10 CFR) 20.1801; and (2) dispose of licensed material by transfer to an authorized recipient, as required by 10 CFR 20.1501(a). The SL IV violation involved the licensee’s failure to monitor, as soon as practicable, the external surfaces of a package labeled as radioactive material, as required by 10 CFR 20.1802.
Paramount Builders, Inc. (EA-24-058/EA-R4-24-014)
On January 13, 2025, the NRC issued a notice of violation and proposed imposition of civil penalty (Notice) in the amount of $9,000 to Paramount Builders, Inc. (licensee) for a severity level III violation. The violation involved the licensee’s failure to confine the possession and use of byproduct material to the purposes authorized in its license, as required by Title 10 of the Code of Federal Regulations (10 CFR) Section 30.34(c). The Notice also includes ten SL IV violations associated with the licensee’s radiation safety program.
