Purpose
The Nuclear Energy Innovation and Modernization Act (NEIMA) was signed into law this past January (https://www.congress.gov/bill/115th-congress/senate-bill/512/text). NRC will host a Category 2 public meeting to obtain feedback from the public on the potential impact of this law on existing non-power reactors. Section 106 of NEIMA, “Encouraging Private Investment in Research and Test Reactors,” changes the criteria for whether a non-power reactor is licensed as a commercial facility (Class 103 license) or a research or test reactor (Class 104(c) license). The law also puts the criterion in the Atomic Energy Act (AEA), whereas before it was only in 10 CFR 50.22. Before NEIMA, the criteria were based on how much a facility spends on commercial activities. The new criteria changes this to how money is made—how much of the cost of owning and operating the facility is recovered from commercial activities.
