Due to a lapse in appropriations, the NRC has ceased normal operations. However, excepted and exempted activities necessary to maintain critical health and safety functions—as well as essential progress on designated critical activities, including those specified in Executive Order 14300—will continue, consistent with the OMB-Approved NRC Lapse Plan.

Glow Rhino, LLC (EA-23-140)

On October 16, 2024, the NRC issued a Confirmatory Order (CO) to Glow Rhino, LLC, memorializing commitments reached during an alternative dispute resolution (ADR) mediation session held on July 18, 2024. The ADR session was associated with two apparent violations related to the possession and distribution of products containing radioactive material without the appropriate licenses, as required by Title 10 of the Code of Federal Regulations Part 30.3, “Activities requiring license.” As a result of the CO, the NRC will not cite the apparent violations and will not issue an associated civil penalty.

Mistras (EA-23-105)

On May 22, 2024, the NRC issued a Confirmatory Order (CO) to Mistras Group, LLC (Mistras) memorializing commitments reached during an alternative dispute resolution (ADR) mediation session held on March 21, 2024. The ADR session was associated with an apparent violation involving the willful falsification of certificates of calibration for non-destructive test equipment used at nuclear power plants. As a result of the CO, the NRC will not cite the apparent violation and will not issue an associated civil penalty.
