Design Certification Renewal Application Review - ABWR Toshiba

Application Withdrawn

By the letter dated June 9, 2016, Toshiba's Corporation submitted a request to the NRC to withdraw the Toshiba Advanced Boiling Water Reactor Design Certification Rule Renewal Application from the docket. On December 30, 2016, the staff issued a letter notifying Toshiba Corporation's that their request to have the COL application withdrawn from the docket has granted in accordance with regulations set forth in 10 CFR 2.107. In addition, a Federal Register notice was published on December 30, 2016, announcing this decision and the basis for granting Toshiba's Corporation request.

On July 13, 1994, the U.S. Nuclear Regulatory Commission (NRC) issued the final design approval (FDA), along with the "Final Safety Evaluation Report (FSER) related to certification of the Advanced Boiling Water Reactor Design" (NUREG-1503). On May 12, 1997, the NRC issued the final design certification rule (DCR) for the Advanced Boiling Water Reactor (ABWR) design in the Federal Register (62 FR 25800). Applicants or licensees intending to construct and operate a plant based on the ABWR design may do so by referencing its DCR, as set forth in Appendix A to Title 10, Part 52, of the Code of Federal Regulations (10 CFR Part 52, Appendix A). A DCR is valid for 15 years from the date of issuance under 10 CFR 52.55(a). A DCR may be renewed for a period of 10 to 15 years.

By letter dated October 27, 2010, Toshiba Corporation (Toshiba) submitted an application to renew the ABWR Design Certification (DC). The purpose of this renewal is to update the ABWR DC. By letter dated December 14, 2010, the staff of the U.S. Nuclear Regulatory Commission (NRC) docketed the application. By letter dated June 22, 2012, Toshiba submitted Revision 1 of their application to renew the ABWR DC.
