01/06/2009 On January 6, 2009, a Severity Level III Notice of Violation was issued to Wackenhut Nuclear Services (WNS) involving 10 CFR 50.5, which prohibits any contractor of a licensee from engaging in deliberate misconduct that causes a licensee to be in violation of any NRC regulation or condition of a license issued by the Commission. An investigation conducted by the NRC Office of Investigations determined that multiple security officers employed by WNS were deliberately inattentive on multiple occasions at Exelon's Peach Bottom Atomic Power Station. In addition, multiple security officers deliberately failed to report observations of inattentiveness to their supervision. These security officers put Exelon in violation of 10 CFR 73.55, which requires armed responders to maintain continuous communication with each alarm station and be available to immediately respond to threats, and Peach Bottom License Condition 2.C(3), which requires, in part, reporting of aberrant behavior.

ORDER 01/22/2008 On January 22, 2008, a Confirmatory Order (Effective Immediately) was issued to Wackenhut Nuclear Services, Inc., (WNS) to establish certain requirements as set forth in the Order including (1) revision to its hiring and recruitment policy; (2) a site enhancement plan for the Turkey Point facility; (3) development of an enhanced leadership program; (4) benchmarking, audits and self-assessments, (5) development of performance indicators for the Turkey Point facility; (6) focused one-on-one training between supervisors and subordinates and continuing communications with the NRC detailing progress on the above six items. The Order was discussed during Alternative Dispute Resolution, and, subject to satisfactory implementation of said requirements, the NRC will not pursue further enforcement action on this issue.

02/24/2005 On February 24, 2005, the NRC issued a Severity Level III Notice of Violation to Williams Power Corporation for the actions of its former Superintendent at Perry who deliberately provided materially inaccurate information to the NRC during an NRC Office of Investigations interview and during a predecisional enforcement conference with the NRC staff.
ORDER 11/14/2005 On November 14, 2005, an immediately effective Confirmatory Order was issued to confirm certain commitments made as part of a settlement agreement for violations issued on February 24, 2005. In response to the violations, Williams Industrial Services Group, LLC, (Williams) requested the use of the NRC's alternative dispute resolution process. The Confirmatory Order establishes requirements that Williams will take to ensure the effectiveness of its safety conscious work environment program and strengthen complete and candid communications with the NRC. Based on the corrective actions Williams has taken and the requirements specified in the Confirmatory Order, the NRC withdrew the deliberate misconduct violation cited on February 24, 2005. In addition, the employee protection violation, originally issued as severity level III, was re-characterized as a violation without a specified severity level.
