Enforcement Manual Change Notice - Revision 13

Revision 13 was issued on July 27, 2026. The change involved updates to select portions of the Enforcement Manual, including Enforcement Guidance Memoranda to Appendix A, primarily to align the document to the most recently issued Enforcement Policy revision, dated February 24, 2026. The changes are as follows:

Major Changes

  1. Provided a new section titled “Graded Approach Panel Process” to capture efficiencies gained when conducting enforcement panels. This also contains a new flowchart of this process in Part I Section 1.2.13.5.
  2. Updated the guidance on modified enforcement panels in Part I Section 1.2.13.2.
  3. Clarified when the NRC would consider a civil penalty for discrimination cases in Part I Section 2.5.2.4.
  4. Enhanced guidance on disputed violations to ensure efficient NRC responses and proportionate use of resources to the dispute in Part I Section 2.8.
  5. Updated Notice of Enforcement Discretion (NOED) guidance to reflect updates to the Enforcement Policy, including clarifying for plants in decommissioning, in Part 1 Section 3.12.
  6. Added new topic, “Individual Enforcement Action Considerations for Allegers Engaged in Deliberate Misconduct” in Part II Section 1.1.13.1.
  7. Clarified that, in agreeing to ADR, the NRC’s interests include corrective actions that are more comprehensive than those expected via traditional enforcement in Part II Section 1.2.
  8. Clarified guidance regarding the NRC’s provision to licensees of potentially disqualifying information about individuals with security clearances when that information is discovered during NRC investigations into potential deliberate misconduct in Part II Section 1.4.11.
  9. Expanded guidance for loss, abandonment, or improper transfer/disposal of regulated material in Part II Section 3.1.
  10. Removed EGM-18-002, "Interim Guidance for Dispositioning Violations for Failure to Control and Maintain Constant Surveillance for Portable Gauges," due to the issuance of a new violation example in section 6.3 of the Enforcement Policy.
  11. Removed EGM 20-003, "Interim Guidance for Dispositioning Violations of Licensed Material Possession and Use Limits," due to the issuance of a new violation example in section 6.3 of the Enforcement Policy.
  12. Added EGM 26-001, “Enforcement Discretion Not to Cite Certain Violations of 10 CFR 50.48 and 10 CFR 50.72 Involving Uncoordinated Circuit Interruption Devices.”

Minor Changes

  1. Clarified that “days” means calendar days, unless otherwise noted, in the Overview section.
  2. Updated the definitions of Yellow and White significance in Part I Section 1.2.8.
  3. Clarified the use of the word “problem” throughout to distinguish the difference between an underlying issue versus when violations are grouped together as an enforcement outcome.
  4. Replaced references of “root cause” with “underlying cause” to standardize language.
  5. Removed references to gaseous diffusion plants per updated Enforcement Policy.
  6. Removed references to the definition of a Confirmatory Action Letter (CAL) due to the definition being updated in the Enforcement Policy.
  7. Other minor editing and formatting changes.
