Due to a lapse in appropriations, the NRC has ceased normal operations. However, excepted and exempted activities necessary to maintain critical health and safety functions—as well as essential progress on designated critical activities, including those specified in Executive Order 14300—will continue, consistent with the OMB-Approved NRC Lapse Plan.

Andrew Averbach

Andrew Averbach has served as the Solicitor of the NRC since 2012. Prior to that, he served as Senior Trial Counsel at the U.S. Department of Justice for ten years, primarily litigating breach of contract claims concerning the storage of spent nuclear fuel. He served in private practice in New York after graduating from the Boston University School of law and clerking for the Hon. Joseph A. DiClerico (United States District Court for the District of New Hampshire), and he is also a graduate of the University of Virginia. This past year, he has briefed and/or argued three circuit court cases in which the major questions doctrine has been invoked, all concerning challenges to the agency's authority to issue licenses for the offsite storage of spent fuel.
