| A M43A1 CHEMICAL AGENT DETECTOR CONTAINING 250 MICROCURIES OF AMERICIUM-241  |
| WAS DISCOVERED MISSING DURING AN INVENTORY CHECK PERFORMED ON 07/24/99 BY    |
| THE 458th ENGINEER BATTALION (RESERVE).   IT IS BELIEVED THAT THE MISSING    |
| CHEMICAL AGENT DETECTOR WAS LOST IN AUGUST, 1998, WHILE THE BATTALION WAS    |
| PERFORMING RESERVE TRAINING AT FORT DRUM MILITARY RESERVATION, NEAR          |
| WATERTOWN, NY.  A SEARCH FOR THE MISSING CHEMICAL AGENT DETECTOR WILL        |
| PERFORMED.                                                                   |

| NRC BULLETIN 91-01, 4 HOUR REPORT.                                           |

| AT 1544 ON 07/26/99, THE PLANT SHIFT SUPERINTENDENT WAS NOTIFIED OF A        |
| NONCOMPLIANCE WITH NUCLEAR CRITICALITY SAFETY APPROVAL (NCSA) PLANT 001.A02, |
| REQUIREMENT #1, WHICH STATES: "THE MAXIMUM SIZE BAG PLACED OVER A SMALL      |
| DIAMETER CONTAINER SHALL BE A MAXIMUM OF 12 INCHES WIDE WHEN LAID FLAT BY A  |
| MAXIMUM OF 36 INCHES TALL".  NUCLEAR CRITICALITY SAFETY PERSONNEL DISCOVERED |
| THAT A BAG ISSUED FROM PORTSMOUTH STORES STOCK (ITEM #16-999-0314) HAS A     |
| WIDTH OF 12-3/16 INCHES AND AN OVERALL HEIGHT OF 36-3/8 INCHES, THUS         |
| VIOLATING ONE OF THE TWO CONTROLS REQUIRED BY THE NCSA.  PLANT PERSONNEL ARE |
| CURRENTLY PERFORMING WALKDOWNS OF ALL AFFECTED SMALL CONTAINER STORAGE AREAS |
| TO ASSURE COMPLIANCE WITH THIS NCSA REQUIREMENT.  THIS EVENT IS REPORTABLE   |
| TO THE NRC AS AN NRC BULLETIN 91-01, 4 HOUR REPORT DUE TO A VIOLATION OF THE |
| DOUBLE CONTINGENCY PRINCIPLE WHERE DOUBLE CONTINGENCY CANNOT BE              |
| REESTABLISHED IN 4 HOURS, AFTER THE INITIAL OBSERVATION OF THE EVENT.        |

| SAFETY SIGNIFICANCE OF THE EVENT:                                            |
|                                                                              |
| THE NCSA APPROVES THE USE OF A BAG THAT MEASURES 12 INCHES WHEN LAID FLAT.   |
| THESE BAGS ARE TO BE USED ONLY TO LIMIT THE SPREAD OF SURFACE CONTAMINATION  |
| AND TO SEAL CONTAINERS FOR SECURITY REASONS.  THEY ARE NOT TO BE USED TO     |
| CONTAIN MATERIAL IN THE CONTAINERS.  THEREFORE, AS LONG AS THE CONTAINER HAS |
| NOT CATASTROPHICALLY FAILED, THE SAFETY SIGNIFICANCE IS LOW AND A            |
| CRITICALITY IS NOT POSSIBLE.                                                 |

| CORRECTIVE ACTIONS TO RESTORE SAFETY SYSTEM AND WHEN EACH WAS IMPLEMENTED:   |
|                                                                              |
| PLANT PERSONNEL ARE CURRENTLY WALKING DOWN ALL SMALL DIAMETER CONTAINER      |
| STORAGE AREAS TO RESTORE NCSA COMPLIANCE.  A "STOP WORK NOTICE" HAS BEEN     |
| ISSUED BY THE NUCLEAR SAFETY MANAGER TO ASSURE THE OUT-OF-SPECIFICATION BAGS |
| ARE NOT USED.                                                                |

| THE NRC RESIDENT INSPECTOR HAS BEEN NOTIFIED BY THE CERTIFICATE HOLDER.      |

| LICENSEE DETERMINED THAT UNDER CERTAIN METEOROLOGICAL CONDITIONS, THE        |
| ULTIMATE HEAT SINK (DRY COOLING TOWERS) MAY NOT BE WITHIN THE LICENSING      |
| BASIS OF THE FACILITY.                                                       |

| "WATERFORD 3 IS NOT ABLE TO MEET LICENSING BASIS FOR ANALYZED RAINFALL       |
| EVENTS.  SPECIFICALLY, A SITE PROJECT STORM WITHOUT ANY DRY COOLING TOWER    |
| SUMP PUMPS AVAILABLE AND A PROJECT MAXIMUM PRECIPITATION WITH ONLY ONE DRY   |
| COOLING TOWER SUMP PUMP AVAILABLE.  SINCE IT IS POSSIBLE THAT WATERFORD MAY  |
| HAVE OPERATED IN A CONDITION WITH ONE DRY COOLING TOWER INOPERABLE AND THE   |
| OTHER DRY COOLING TOWER HAVING ONLY ONE SUMP PUMP AVAILABLE, A PROJECT       |
| MAXIMUM PRECIPITATION COULD HAVE INCAPACITATED THE OPERABLE DRY COOLING      |
| TOWER.  BASED ON THE CURRENT DRY COOLING TOWER SUMP PUMP CONFIGURATION AND   |
| PREDICTED RAINFALL, BOTH DRY COOLING TOWERS REMAIN OPERABLE.  THE PLAN IS TO |
| INSTALL A HIGH CAPACITY PORTABLE DIESEL SUMP PUMP IN EACH DRY COOLING AREA   |
| WITHIN 24 HOURS."                                                            |

| THE ABOVE CONDITION WAS DISCOVERED BY THE LICENSEE DURING A REVIEW OF A      |
| DESIGN MODIFICATION.                                                         |

| THE LICENSEE INFORMED THE NRC RESIDENT INSPECTOR.                            |
