12/12/2017 On December 12, 2017, the NRC issued an NOV/CP in the amount of $22,400 to Qal-Tek Associates, LLC, for a Severity Level II problem.  The violations involved the failure to comply with 10 CFR 71.5(a), which requires licensees that deliver licensed material to a carrier for transport to comply with the applicable U.S. Department of Transportation requirements in 49 CFR Parts 171 to 180.  Specifically, Qal-Tek shipped five radioactive sources in a single 10‑gallon steel drum shipping container.  Three of these sources were also located in an inner lead container (commonly referred to as a "pig").  The shipment went through several airports without incident from Idaho Falls to a temporary jobsite in New York City.  For the return transport of the sources to Idaho Falls on April 11, 2017, a licensee radiation safety officer prepared the package in the same manner as the initial shipment, but the lid of the pig opened during transport.  As a result, three of the sources moved from the pig into the surrounding sealed steel drum.  Dose rates measured at 1 meter and on contact exceeded NRC regulatory limits; however, the NRC's analysis concluded that a member of the public was unlikely to have received a dose in excess of regulatory limits.

07/23/2016 On July 23, 2016, the NRC issued a Notice of Violation to QHG of Indiana, Inc., for a Severity Level III violation involving the failure to develop, implement, and maintain written procedures to provide high confidence that each administration is in accordance with the written directive as required by 10 CFR 35.41(a). Specifically, on January 7, 2016, during two separate medical administrations, the licensee used an instrument that was not capable of measuring with high confidence the amount of yttrium-90 remaining in the equipment used to deliver the dose. Therefore, the licensee could not determine that the two administrations were in accordance with the written directive. The licensee's procedures did not specify the instrumentation needed to provide high confidence that the administration would be performed in accordance with the written directive.

09/13/2006 On September 13, 2006, a Notice of Violation was issued for a Severity Level III violation involving the failure to control and maintain constant surveillance of a portable nuclear gauge resulting in damage to the gauge. Specifically, the gauge was left unattended for approximately 5 minutes while the gauge user was approximately 150 feet away from the gauge. During the time the gauge was not within the user's line of sight, it was run over by a bulldozer.

04/01/2024 On April 1, 2024, the NRC issued a notice of violation (Notice) to Quality Inspection & Testing, Inc. (licensee) for a Severity Level (SL) III violation. The violation involved the licensee’s failure to have a radiation safety officer as required by License Condition 12 of its NRC Materials License 17-35492-01. The Notice also included one SL IV violation.

ORDER 08/10/2012 On August 10, 2012, the NRC issued a Confirmatory Order (Effective Immediately) to Quality Inspection and Testing, Inc. (QIT) to formalize commitments made as a result of an ADR mediation session. The commitments were made by QIT as part of a settlement agreement between QIT and the NRC regarding apparent violations of NRC requirements by the lead radiographer and the radiographer’s assistant. The agreement resolves the apparent violations that were identified during NRC inspection and investigation and involve QIT’s failure to comply with requirements including: maintaining control and constant surveillance of licensed material that is not in storage (10 CFR 20.1802); wearing a direct reading dosimeter, alarm ratemeter, and personnel dosimeter while conducting radiographic operations (10 CFR 34.47); and maintaining records and documents (10 CFR 34.89). QIT agreed to a number of additional corrective actions beyond actions taken, including such areas as: (1) issuance of a policy statement addressing each of the areas of violation; (2) issuance of a letter from the QIT president regarding compliance and communicating concerns to management; (3) enhancing their training program; (4) submitting a number of procedures for NRC review and approval, such as management oversight and reporting concerns; and (5) presenting a paper for a professional society meeting. Additionally, QIT agreed to pay a civil penalty in the amount of $3,500.

ORDER 03/10/2009 On March 10, 2009, a Confirmatory Order (effective immediately) was issued to Quality Inspection Services, Inc. (QISI) to confirm commitments made as a result of an Alternative Dispute Resolution (ADR) settlement agreement. The licensee requested ADR following the NRC's September 15, 2008, Notice of Violation and Proposed civil penalty of $6,500, for a willful violation of 10 CFR 34.71, involving the failure to maintain utilization logs of radiographic activities and three other related violations. As part of the agreement, QISI agreed to take a number of actions including revising the existing Operations and Emergency (O&E) Manual, adding a radiation safety component to the existing Newsletter, developing a video recording that can be used for a presentation at a national industry conference, increasing audits of the radiographers working areas, and an inquiry of all radiographers during the next two annual radiation safety program reviews. In recognition of QISI's proposed extensive corrective actions, in addition to corrective actions already taken, the NRC agreed to reduce the civil penalty originally proposed to $500.

09/15/2008 On September 15, 2008, a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $6,500 was issued for a Severity Level III violation. This action is based on a willful violation of 10 CFR 34.71, involving the failure to maintain utilization logs of radiographic activities. Specifically, between November 15, 2006 and March 2, 2007, the licensee's site radiation safety officer performed radiographic operations at the Connecticut site, without maintaining utilization logs. In addition, three related Severity Level III violations were also issued for failures to: (1) provide complete and accurate information by licensee's site radiation safety office and assistance radiographer, regarding the use of the proposed permanent fixed installation in the Manchester facility; (2) obtain NRC approval prior to conduct of radiographic operations at the Manchester permanent radiographic installation; and (3) accompanied by at least one other qualified radiographer when the licensee's corporate radiation safety officer performed radiographic operations in the proposed permanent radiographic installation.
