04/18/2013 | On April 18, 2013, the NRC issued a Notice of Violation and Proposed Imposition of Civil Penalties in the amount of $36,400 to to Chicago Bridge & Iron’s (CB&I) facility in Charlotte, North Carolina, formerly known as Shaw Power Group (SPG). This action is based on two violations associated with 10 CFR 52.5, “Employee protection.” Specifically, SPG terminated a former Quality Assurance Supervisor on May 20, 2011, because he notified Louisiana Energy Services, a Nuclear Regulatory Commission licensee, of a potential 10 CFR Part 21 issue regarding apparently faulty rebar that may have been shipped to their facility by a third party vendor. This employee protection issue was categorized as a Severity Level II violation. The second violation relates to the prohibitive language in Shaw’s Corporate Code of Conduct which prohibits, restricts, or otherwise discourages an employee from participating in a protected activity including notifying an NRC licensee of matters within the NRC’s regulatory responsibility. This issue was categorized as a Severity Level III violation. |
