Summary - Complete Revision Based on Enforcement Review Team Recommendations

On June 30, 1995, the Commission published a complete revision of its Enforcement Policy based on the recommendations of a high-level review team tasked with evaluating the agency's enforcement program and Enforcement Policy (see NUREG-1525). The revisions were intended to produce an enforcement program with clearer regulatory focus and more predictability. Among other changes, this revision eliminated encouraging improvement of licensee performance as a stated purpose of the enforcement program, introduced a simplified process (with graphic representation) for assessing civil penalties and eliminated the enforcement process for and the existence of Severity Level V violations. In making the latter change, the Commission recognized the existence of minor violations, but took the position that these violations should not normally be documented to better focus the inspection and enforcement process on safety.
