SUBJECT: RESPONSE TO RELAXATION REQUEST AND WITHDRAWAL OF DECEMBER 10, 2004 ORDER SUSPENDING LICENSE (EFFECTIVE IMMEDIATELY) (EA-04-148)

Dear Mr. Lynch:

This is in response to your February 17, 2005, letter requesting a relaxation of the December 10, 2004, "Order Suspending License (Effective Immediately" for your Bloomsburg, PA facility. In Safety Light Corp., CLI-05-07, 61 NRC ___ (Feb. 22, 2005), the Commission exercised its supervisory role over licensing and enforcement proceedings and lifted the immediate effectiveness of that Order. A copy of CLI-05-07 is attached for your information.

In light of the Commission's February 22, 2005, ruling, no action on your request for relaxation is necessary. In addition, we are hereby withdrawing the December 10, 2004 Order. Accordingly, Materials License Nos. 37-00030-02 and 37-00030-08 remain in timely renewal status pending a final Agency decision in the ongoing adjudicatory proceeding (Docket Nos. 30-5980-MLA, 30-5982-MLA, 30-5980-EA, and 30-5982-EA). This action does not preclude the staff from taking additional enforcement action to address the violations in this case, if warranted.
