Tennessee Valley Authority (TVA) Clinch River Site
By letter dated November 5, 2010 to the NRC, TVA outlined six key assumptions for the possible licensing and construction of up to six Babcock & Wilcox (B&W) mPower design small modular reactor (SMR) modules at its Clinch River site in Roane County, Tennessee. TVA indicated that they would request a 10 CFR Part 50 construction permit for two to six modules by submitting a preliminary safety analysis report to the staff. Following TVA's receipt of the staff's draft safety evaluation report and concurrent with TVA's submission of its Clinch River operation license (OL) application, TVA expects B&W to submit a Part 52 design certification application for the mPower SMR. TVA also anticipates that subsequent modules at the TVA Clinch River site would be licensed based upon Part 52 combined license (COL) applications.
The NRC staff requested additional details regarding the key assumptions in a letter dated December 1, 2010 and a public meeting with TVA was held on December 14, 2010 to further discuss TVA's assumptions. As a result of the public meeting, TVA submitted an addendum to the original key assumptions in a letter dated December 22, 2010. The NRC responded to TVA by letter dated January 31, 2011, that there is no legal or licensing issue that would prevent TVA from applying for a construction permit and operating license under 10 CFR Part 50.

Regulatory Framework Development
As described in TVA's letters dated November 5, 2010 and December 22, 2010, TVA plans to use its Regulatory Framework Process to identify and resolve gaps that exist between older regulatory guidance associated with Part 50 licensing of a new nuclear facility, and the current regulatory requirements. As this framework evolves, this page will be updated.
